DUTY HOLDER-WHAT TO YOU NEED TO DO
In short you need to find out where your ACM's (asbestos containing materials) are and more importantly what condition they are in. once you have done that you need to put a plan in place to deal with any ACM's that may be in a poor condition or at risk of being damaged.
Seven Step Guide to Compliance and Asbestos Management(Flow Chart)
- Step 1- Confirm what you already know about the Asbestos Containing Materials on your premises and review how you are currently managing them
- Step 2- Prevent work on your premises that may disturb the fabric of the building until measures to control the risk have been implemented
- Step 3- Carry out an initial inspection for the damage and disturbance of materials and take immediate action to control these
- Step 4- Develop a strategy for compliance
- Step 5- Carry out a risk assessment of your Asbestos Containing Materials to set priorities for management
- Step 6- Develop a long term management plan
- Step 7- Monitor and review the management plan
What happens if I don't comply?
Where there has been a breach enforcement action will be taken by the EHO/HSE unless the organisation or individual can demonstrate a full and robust asbestos management plan. This could result in an unlimited fine or upto 2 years in prison. This duty now extends to board level so Directors are now at risk from prosecution if an adequate asbestos management plan has not been put in place.
